Defense attorneys moved Thursday to bar the Ventura County District Attorney's Office from prosecuting hundreds of drunk-driving cases that they say rely on faulty or unlicensed alcohol tests conducted by the county crime lab. With lawyers crowded around the defense table and overflowing into the jury box, defense attorney Robert Huber told a judge that prosecutors and the County Counsel's Office should be recused from the cases. He claimed their close relationship with the Ventura County Sheriff's Department lab presents a conflict of interest that could prevent DUI defendants from getting a fair trial. ``Given that the district attorney is trying to sanitize the actions of the sheriff's (crime lab), asking the district attorney to handle this matter is like asking the fox to guard the hen house,'' Huber said. Superior Court Judge Steven Z. Perren scheduled arguments for July 11, when he will determine whether to turn the misdemeanor drunk-driving cases over to the state Attorney General's Office. They include pending cases, as well as those that have already been adjudicated through plea bargains and jury trials. So far, 20 defense attorneys have banded together on this issue - most of whom are challenging fewer than a half-dozen cases. However, the Public Defender's Office has sent letters to 192 current and former DUI clients, asking if they want to contest their case. Perren gave attorneys until noon Tuesday to present him with a list of the cases to be challenged. The crime lab's problems date to March 19, when the state ordered the crime lab to stop testing blood, urine and breath samples for alcohol. Despite the order, Ventura County sent its blood and urine samples to the state lab, but continued analyzing breath samples. Prosecutors filed cases based on the breath results, saying they were unaware of the state's ban - a statement since contested by sheriff's officials. However, prosecutors now maintain that the state's license was never actually suspended, so the test results are valid. Even as defense attorney were challenging cases based on breath analyses, a sheriff's investigation found that Vitale had overstated the alcohol levels in 34 blood tests. Vitale was placed on paid administrative leave, effective Wednesday, officials said. Thursday's hearing was attended by three prosecutors, who made no statement as defense attorneys accused their office of withholding evidence and of failing in their ethical obligation to investigate the loss of the lab's license. ``We're having tremendous trouble trying to obtain discovery from the crime lab or District Attorney's Office,'' said Deputy Public Defender Brian Vogel, a designated leader for the defense attorneys. Prosecutors also had no comment about the defense attorneys' efforts to disqualify their office from prosecuting the DUI cases. ``We don't know if we're in this case or not,'' Deputy District Attorney Pete Kossoris said. District Attorney Michael Bradbury and Sheriff Larry Carpenter did not return phone calls. Norm Fort, who retired Nov. 19 as the lab's forensic lab supervisor, was in court as a subpoenaed witness. He did not testify but said outside of court that he suspects the Sheriff's Department will try to pin blame for the crime lab's problems on him, although his retirement precedes the testing difficulties. Fort said he has seen an internal sheriff's memo drafted by his successor which is critical of his operation. ``The way I translate the multiple-page memo is as a witch hunt,'' Fort said. ``I think they're trying to focus attention away from the problems at the crime lab and onto Norm Fort.'' Fort's attorney, Peter Goldenring, said Fort had received ``certain threats, direct and indirect'' apparently intended to keep him from testifying about the lab's alcohol testing procedures during his tenure there. More than 25 years have passed since the first cases of AIDS were
reported, and from the very beginning the pathogenesis of the disease has presented scientists with a paradox: HIV infection is associated with the persistent activation (revving up) of the immune system, and yet 24 hour emergency plumbing also with eventual immune deficiency. In this relatively simple formulation, immune activation simply reflected the body's attempt to generate new CD4 T cells ("tap") to replace those that HIV was assumed to be killing ("drain"). The fact that this idea was relatively easy to grasp made it very seductive and even in 2006, it is possible to find information on HIV/AIDS that treats the tap and drain model as the leading theory of pathogenesis. However, few immunologists were convinced by the simple plumbing scheme that Ho invoked. Several leading immunology researchers wrote to Nature to point out obvious flaws in this theory as soon as it was published, but their correspondence received little media attention. Over time, the dissenters in the immunology community produced data conclusively rejecting Ho's theory. The increase in CD4 T-cell counts that occurs immediately after initiation of antiretroviral therapy (ART) was shown to primarily reflect the redistribution into the blood of CD4 T ceils that had been trapped in the lymph nodes and other tissues; the initial rise in CD4 T cells did not signify the production of new cells as Ho's model predicted. Also, it had already been reported (by the late Janis Giorgi at UCLA) that immune activation markers on CD8 T cells were elevated and correlated with disease progression. And yet, CD8 T cells are not depleted by HIV. Subsequent sophisticated analyses of T-cell activation and proliferation in people with HIV showed that CD4 and CD8 T-cell activations are tightly correlated, confirming that immune activation does not reflect an attempt by the immune system to replace CD4 T cells killed by HIV. A number of studies have also reported that markers of immune activation correlate better with disease progression than viral load. Taken together, these data have led to a near total consensus in the scientific community that immune activation plays a critical causative role in HIV pathogenesis. Leaks and Patches The widespread agreement about the importance of immune activation reflects progress in the study of HIV pathogenesis, but it still leaves many questions to be addressed. Examples include: * What is causing immune activation in HIV infection? * Why and how does immune activation persist? * Why are peripheral blood CD4 T-cell counts more affected than peripheral blood CD8 T-cell counts? * How does immune activation lead to the eventual development of immunodeficiency? A number of theories are emerging that go some way towards suggesting answers to these questions, but controversies remain. A recently popularized theory posits that HIV does most of its damage very early, by decimating the memory CD4 T-cell population in the gut within weeks of infection. However, skeptics point out that gut CD4 T cells have distinct properties that may make them unrepresentative of the CD4 T-cell population as a whole, and that the proportion of CD4 T cells that reside in the gut--often incorrectly said to be more than half of the total--has been overestimated. An additional provocative suggestion associated with the gut CD4 T-cell depletion theory is that HIV's early impact on the gut compromises the integrity of the gut surface, allowing the "friendly" bacteria that aid digestion to leak into the system, thereby provoking an immune response and causing systemic immune activation. Some preliminary evidence has recently been published in support of this notion, but it remains unproven and controversial. Another line of reasoning posits that HIV has the ability to alter the behavior of CD4 T cells by binding to CD4 and CCR5, potentially inducing activation, affecting immune trafficking patterns, and/or triggering cell death. Other researchers are looking at HIV's early impact on the development of the CD4 T-cell response to the virus itself (the HIV-specific CD4 T-cell response) as potentially setting the stage for the failure of the immune system to control HIV replication over the long term. One research collaboration that is attempting to address a broad array of pathogenesis questions is the Cleveland Immunopathogenesis Consortium, headed by Mike Lederman from Case Western Reserve University. Lederman and a diverse group of colleagues have drawn up a plan to conduct small trials of a variety of potential immune-based therapies, with the goal of both assessing their potential and examining whether the effects of the therapies can shed light on the veracity of current pathogenesis theories. The Pipeline A full understanding of HIV pathogenesis would represent a colossal milestone on the road towards a cure for AIDS, but the opacity of the human immune system remains a stern challenge to researchers pursuing this goal. It's also important to recognize that this pursuit is occurring in an increasingly challenging funding environment; the number of government grants to new investigators is dwindling and the era of large increases to the National Institutes of Health's budget appears to be over. For community activists, the issues involved in HIV pathogenesis research can seem overwhelmingly complex. However, it is crucial for us to support scientists working in this area and to advocate for appropriate funding for not just HIV research, but for basic immunology research that will enable us to understand the complex milieu in which the virus is operating. Resume/application customization is becoming increasingly important now because resumes and applications are usually stored in an employer's resume database or applicant tracking system ("ATS").
In addition, several recent studies have indicated that the human reviewer -- if/when they do actually see your resume -- will spend fewer than 10 seconds looking at it before deciding whether or not you are qualified for the opportunity. Appropriate Customization Pays Off! Carefully done, customizing your resume should do two things for you: Your resume will pass the critical keyword test. Do the right customization (adding the appropriate keywords) so that the employer's ATS recognizes that you are a fit with the job's requirements. With the right keywords for the opportunity included in your resume, the ATS should make your resume visible to the people doing the resume screening. Your resume will impress the human reviewer. This may be the biggest challenge in the whole process, so far. Once your resume passes through the ATS and is seen by a human being, it needs to show the human reviewer -- in a 10 second scan -- that you are qualified for the job and deserve further consideration. How to Customize Your Resume in 5 Quick Steps Don't be discouraged or intimidated! Customizing your resume does NOT mean a complete re-write of your resume for each opportunity, assuming that you are applying for the same kind of jobs with every employer. But, it does mean taking a little more time than simply clicking on the "Apply" button. Since your first goal is to ensure that your resume contains enough of the appropriate keywords that it is seen by a human being, start by focusing on the keywords needed by the ATS. Then, add content to appeal to the person briefly viewing your resume. Focus on the top half of the first page of your resume -- "above the fold" as they say in the web development and newspaper publishing worlds -- where the content is obvious to someone doing a quick visual scan. 1. Analyze the job description. Carefully read the job description. Make note of: The job title used in the description The duties and responsibilities The specific requirements The location Don't waste your time applying if you don't meet at least 50 percent of the job's requirements. 2. Customize your resume's "Target Job Title" or "Objective" to match the job title in each job description. Resume expert and author Martin Yate recommends using a "Target Job Title" at the top of your resume, below the standard name and contact information. If you want to be more traditional, you could call it "Objective," just do NOT use an old-fashioned, meaningless, and keyword-less objective (e.g., "Achievement-driven, highly motivated administrative professional seeking challenging opportunity in a high-growth..."). If the employer has used a standard job title, the one already on your resume, you are all set. However, if they used a unique version of the job title, match it. For example, let's assume that you are an experienced administrative assistant looking for a similar job, and let's assume that you found a good job which the employer has labelled, "Medical Administrative Assistant." So, for this example, "Medical Administrative Assistant" would be the exact title you would put at the top of your resume as the Target Job Title or Objective. Thus, it would be seen immediately, making it clear that you want this job. 3. Customize your skills, as appropriate, to match the terms used in the job description. Continuing our example, doing a quick scan of the requirements for the medical admin assistant job posting, assume that you find the following language used - Job description: Advanced knowledge of Microsoft applications (Word, Excel, PopwerPoint) required. Ideally, assuming you do have the skills required, you would be smart to match the reference in your resume with the terms used in the job description. Let's assume that your resume currently describes your Microsoft Office skills like this: Original resume: Proven expert in the use of the entire Microsoft Office suite of products. Notice that the original resume lacks important keywords which are included in the job description (applications, Word, Excel, PowerPoint). This could result in the resume remaining in the ATS, never to be seen by a human being. Recognizing this problem, you could adjust your resume to match the description: Submitted resume: Advanced knowledge of Microsoft Office applications - Word, Excel, PowerPoint, Access, Publisher, OneNote, and Outlook. This matches the language in your resume with the language used in the description, and should help your resume pass the keyword-matching requirements. It also adds the terms "Office," "Access," "Publisher," "OneNote," and "Outlook" to demonstrate your complete expertise and also to expand, clarify, and/or confirm your qualifications. Including additional terms is fine. Being too complete (having too many keywords) is preferable to not having enough keywords, as long as the keywords used are appropriate for you and not just a meaningless list of words. 4. Highlight your matching skills in a special section at the top of the resume. Resume expert Martin Yate recommends capturing real estate agents the human reviewer's attention by clearly lining up your experience with the requirements in the job description in a section at the top of your resume, below your contact information and the "Target Job Title" or "Objective," labelled "Performance Summary." Other resume experts recommend naming the section, "Summary of Qualifications" or simply "Summary." In that section, which needs to have only 3 to 5 bullets for most jobs, pick your experiences or achievements that seem to best match the most important requirements in the job description. Or, the relevant achievements you have that are most impressive. 5. Confirm your location. The top of your resume should indicate your location, generally. Don't publish your home or work addresses on your resume (EVER!), but do include a city, county, or other regional term, like "East Bay" or "Metro West," that fit with the job's location. Use your current location or, if you are trying to relocate, your future location. By including a location that fits with the employer's requirements, you are confirming that you could be a good match. Employers are usually sensitive to the location of the job candidate in relation to the location of the job. They prefer to hire someone who is located near the job's location, for many good reasons: a local candidate is more likely to stay in the job, a local candidate is more likely to be on time, and a local candidate will not need an expensive relocation. Assuming that the job is appropriate for you, the rest of your resume probably needs little, if any, customization. The customization you have done for the top of the first page of your resume has probably not taken you very much time, but it should have a good payoff.
